The Difficulties of Family Based Immigration

Finding your perfect match and starting a family abroad seems like a dream, but trying to move a new family back to the United States might actually turn out to be a logistical nightmare. Considering the paperwork and extra expenses found along the way, it could be months or even years before you and your family’s paperwork and visas are approved.

So what seems to be the problem with Family Based Immigration? The United States has a strict regimen of interviews and hurdles to get through to make sure that illegal or scam immigrants do not obtain citizenship.

The first step on the journey of family based immigration is actually starting out. It sounds silly but a lot of people do not know where to begin. The first step in the process is filling out a form called the I-130 or immigrant visa petition. This form will help Immigration Services determine the validity of the relationship between the petitioner and the potential immigrant. It should be noted that each potential immigrant must have a separate I-130 form filled out.

The next step is one of the hardest which is waiting for an available immigrant visa number. This wait period could take anywhere from 3 to 9 months, depending on the schedule of the US Citizenship and Immigration Services (USCIS). It is during this period of waiting where many petitions lose their momentum and eventually fail.

Once the immigrant visa number is given out, the USCIS may ask for financial documents such as bank statements as well as income tax returns to determine the ability of the petitioner to financially provide for the potential immigrants. As long as the petitioner keeps a good record of these documents then this step should be easy.

Lastly there will be an interview process as well as a slew of medical appointments needed before the process is complete. The medical test and treatments might be a bit expensive depending on which country the potential immigrant lives in, so be prepared for that.

While the process can potentially become long and drawn out, with a little patience things should turn out favorably. However at any time during the long process there is confusion there are always lawyers that can help out those in need.
